DISPUTE RESOLUTION POLICY

MotoPOCKETS agrees to use reasonable efforts and reasonable methods to resolve any disputes or discrepancies that arise regarding you and MotoPOCKETS. As part of the dispute resolution process, you also acknowledge and agree that you as the Authorized User or the Cardholder will not initiate any charge-back or claim procedure with our Merchant Bank or your creditor without first obtaining a special claim confirmation number from us to verify that you contacted MotoPOCKETS and provided us with the opportunity to resolve the claim or dispute, even if we were ultimately unable to provide a resolution.

Purchases using credit cards: When you place your order using a credit card, MotoPOCKETS authorizes your purchase by verifying that your card has the available funds. Your credit card provider sets aside those funds so you may not spend them on anything else. MotoPOCKETS then “captures” or takes the funds for purchased MotoPOCKETS Products only after they ship. Please note that if your purchase does not complete for any reason, such as your card being declined by our Card Processor or your bank, the set-aside funds may continue to be unavailable for you to spend for several days, but will not be taken by MotoPOCKETS.

Purchase using PayPal: When you place your order using PayPal, the purchase amount is deducted from your PayPal-associated account immediately.

Policy Regarding Back-orders and Delivery Delays: Back-orders will be shipped when the affected MotoPOCKETS Product become available. Some items may require prepayment.

Delivery Delays: Some MotoPOCKETS Products in the MotoPOCKETS warehouse may not be in stock and may have to be provided from our factory. Therefore, the shipping method you have chosen during the order process only pertains to MotoPOCKETS products leaving our location in San Diego, CA to your desired destination. Delivery from our manufacturer to our San Diego location is sometimes unpredictable. If we become aware that shipment of the MotoPOCKETS product you ordered is being delayed for any reason, we will attempt to contact you; otherwise the MotoPOCKETS product will ship promptly after we receive it.

 

Limited Lifetime Warranty Exchange

Moto Pockets provides, to the original purchaser, a limited lifetime warranty against defects in materials or craftsmanship if purchased directly from an authorized Moto Pockets dealer or from our website. This warranty covers defective materials and craftsmanship only, and does not include damage due to normal wear and tear or misuse. Failure to comply with Moto Pockets product instructions (either included with product or on website) will void the limited lifetime warranty. If defects in the materials or craftsmanship of the product exist, do not use the product and notify Moto Pockets immediately of the defect. Moto Pockets will provide repair or replacement of the product after Moto Pockets has determined, in our sole discretion, that a defect is present. Proof of purchase is required. We Cover: 

  • Replacement parts and labor.

  • Shipping of the product to the Customer.

     

What we don’t Cover:

  • MotoPOCKETS is not responsible for any personal injury or injury to others caused by in-correct usage, misuse, accident or incident involving the product in a way that it was not originally intended for.

  • MotoPOCKETS does not warrant any product which is damaged from abuse, lack of maintenance or is not used for its intended purpose. Normal wear and tear is excluded.

  • This Limited Warranty does not cover or apply to any loss or damage to the motorcycle or any other items which may have been caused by the defective product and does not apply to personal injury, repair or other incidental costs caused by the defective product.

  • Sales outside of the United States and any other expenses are not covered.

  • This Limited Warranty does not cover any MotoPOCKETS Product purchased through non-authorized dealers and/or online auction websites.

  • Non-authorized dealer receipts and/or online sales auction confirmations are NOT accepted for warranty verification.

  • Consequential damages, incidental damages or incidental expenses, including damage to property are not covered.

  • Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Specific state legislation should be referred to in this case.

  • MotoPOCKETS has no liability for any damage or destruction to consumer electronics or personal items and property that are contained inside or outside MotoPOCKETS’ products, including, without limitation, tablets, computer equipment, cameras, cell phones, or other handheld devises or any loss of data contained in the previous devises.

  • The limitations of liability set forth above shall apply to the maximum extent permitted under applicable law.
